Terms and Conditions

Maison Handal provide access to the maisonhandal.com website (the “website”) and sell goods and services to you, subject to the terms and conditions set out below and by the privacy policy available to view elsewhere on this website. By using the website, you agree to be bound by these terms and conditions which together with our privacy policy govern the products and services supplied by Maison Handal and Maison Handal’s relationship with you while you use this website.

Delivery destinations

We only provide store pickup services at our physical locations and our affiliated partners’ locations. It is the user’s responsibility to get informed about the available pickup locations listed elsewhere on the site and choose the correct one to pickup order at the checkout process. Any orders that do not comply with these specifications will be cancelled and refunded.

Terms of sale of products

Your order represents an offer to us to purchase a product or service and is subject to the following terms and conditions. Your order is accepted by us when we send email confirmation and/or a redirect to a webpage which provides details of how we have made that product or service available to you. That acceptance will be complete at the time we send the order confirmation email and/or web page redirect to you.

All orders are subject to availability and confirmation of the order price.

You must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us or be in possession of a MonCash account or have been cleared by our accounting department to issue check payments.

When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorized user payment information provided to place your order and that there are sufficient funds to cover the cost of the goods.

Maison Handal retains the right to refuse any order request made by you.

Delivery

We aim for you to receive your order at the chosen pickup location within a week of placing it, if this location is in the metropolitan area of Port-au-Prince. Note that delivery to locations in other geographical departments can result in longer delivery times.

Returns

Purchases made at Maison Handal can be returned or exchanged with an original receipt within 15 days of purchase and the product returned must be unopened. Products returned within this time frame will be refunded, minus any shipping charges.

Pricing/Availability

While we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

All prices are generally inclusive of VAT and may include delivery charges; if delivery charges are over and above the price of purchase, such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.

Cancellations/change to order

In exceptional circumstances we may agree to cancel or change an order. We can only accept a cancellation or change if we receive cancellation notice from you before we have dispatched your order. You will be responsible for, and your provided payment information may be charged for, the payment of all fees associated with orders already processed or shipped before your cancellation/change request was received.

Warranties and liability

The material displayed on this website is provided without any guarantees, conditions or warranties as to its accuracy.

Unless expressly stated to the contrary, Maison Handal and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever.

Indemnity

You agree to indemnify, defend and hold harmless Maison Handal, their directors, officers, employees, consultants, agents, and affiliates, from all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this website or your breach of the Terms and Conditions.

Variation

We have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

Complaints

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Governing Law

These terms and conditions are to be construed in accordance with the laws of Haiti and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Haitian courts.
